Shipping and Returns Policy for Tomident

This Shipping and Returns Policy governs the dispatch, delivery, and return of Products ordered from Tomident Pty Ltd (ABN: 82 167 519 922) ("Company," "we," "us") via the website https://www.tomident.com/ ("Website"). By placing an order, you agree to this policy, which forms part of our Terms and Conditions. This policy complies with the Australian Consumer Law (ACL) under the Competition and Consumer Act 2010 (Cth).

1. Shipping

1.1 Dispatch

  • All orders are dispatched within 48 hours of payment confirmation, provided items are in stock.

  • Orders are shipped via Toll Priority or other courier services, subject to the carrier’s terms and conditions.

1.2 Delivery

  • Deliveries are made to physical addresses in Australia and New Zealand only. We do not ship to PO Boxes.

  • Deliveries occur Monday to Friday, 9:00 AM to 5:00 PM AEST, excluding public holidays.

  • A signature may be required upon delivery, as per the carrier’s terms.

  • Customers must ensure shipping details are accurate at the time of order, as we cannot redirect orders once dispatched.

  • If no one is available at the delivery address, the carrier (including Australia Post) may leave a collection card or instructions for arranging redelivery. Customers are responsible for coordinating redelivery directly with the carrier.

1.3 Delivery Issues

  • The Company is not liable for delays, losses, or damages during transit, except as required by the ACL.

  • Customers must inspect deliveries promptly and report any issues (see Section 3).

2. Returns

2.1 Return Process

  • To return a Product, contact our sales team at info@tomident.com or (02) 9799 1414 to obtain a Return Authorisation Number (RA#).

  • Returns must be sent within 14 days of the original invoice date.

  • Non-defective returns must be unopened, in original packaging, and in saleable condition (no labels, stickers, or writing on the box).

  • Defective Products are subject to manufacturer testing to determine eligibility for credit or exchange.

  • Special Buy-In items are non-returnable unless deemed faulty by the manufacturer.

2.2 Restocking Fee

  • A 30% restocking fee applies to non-defective returns, unless otherwise required by the ACL.

2.3 Australian Consumer Law

  • Our Products come with guarantees that cannot be excluded under the ACL. You are entitled to:

    • A refund or replacement for a major failure, and compensation for any reasonably foreseeable loss or damage.

    • Repair or replacement if the Product fails to be of acceptable quality and the failure is not a major failure.

  • Contact us to discuss your ACL rights for defective or non-compliant Products.

3. Damage, Defects, and Loss in Transit

  • Customers must inspect Products upon receipt and notify the Company in Writing within 10 working days of receiving the invoice or the Products (whichever is later) regarding:

    • Damage, defects, or shortages in delivery.

    • Loss in transit.

    • Non-compliance with the order.

  • Notifications must be sent to info@tomident.com or 96 Elizabeth St, Ashfield NSW 2131, Australia.

  • Failure to notify within 10 working days may result in loss of any claim related to the issue, subject to ACL rights.

  • Defective Products will be tested by the manufacturer to determine eligibility for refund, replacement, or repair under the ACL.
